KEDAULATAN (SOVEREIGNTY) DALAM POLITIK ISLAM DAN NEGARA KESATUAN REPUBLIK INDONESIA (Suatu Perbandingan)

Abstract

This paper examines how the concept of sovereignty in Islamic politics and in the Unitary State of the Republic of Indonesia, then compares whether sovereignty in the constitution of the Republic of Indonesia is in accordance with sovereignty in Islamic politics. This issue is important to study, not only because there are differente opinions about sovereignty in Islamic politics, but also because some Muslims are still have a view that the sovereignty adoptedby the Indonesian constitution is incompatible with the political teachings of Islam. To get an answer to the subject matter under study, the author uses the theories of sovereignty presented by political scientists, namely the theory of God's sovereignty, the theory of king's sovereignty, the theory of people's sovereignty, the theory of state sovereignty, and the theory of legal sovereignty. To find out how the concept of sovereignty in Islamic politics, the data used is obtained through literature studies with a historical approach and the text of the Qur'an and Hadith. Meanwhile, to find out the concept of sovereignty in the Republic of Indonesia, the data used is the 1945 Constitution. The results show that the concept of sovereignty in Islamic politics is the same as the concept of sovereignty adopted by the Republic of Indonesia, which is equally combining theocracy, nomocracy and democracy.
